Precision Metalforming Association, PMA Services, Inc., and PMA Educational Association provide websites and services subject to the rules published below. These may be updated by us from time to time without notice to you.

Cookies

A cookie is a small data file that certain websites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you've visited, but the only personal information a cookie can contain is information you supply yourself. Governing Law and Jurisdiction

This site (excluding linked sites) is controlled by PMA from its offices within the state of Ohio, United States of America. By accessing this site, you and PMA agree that all matters relating to your access to, or use of, this site shall be governed by the statutes and laws of the State of Ohio, without regard to the conflicts of law's principles thereof. PMA makes no representation that materials on this site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.

Indemnity

Limitation of Liability

You expressly understand and agree that PMA shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if PMA has been advised of the possibility of such damages), resulting from:

  • the use or the inability to use the site;
  • the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the site;

In no event will PMA be liable for:

Notification of Copyright Infringement

PMA will, in appropriate circumstances, terminate the accounts of users who infringe the intellectual property rights of others. If you believe that your work has been used or copied in a way that constitutes copyright infringement, please provide PMA's Copyright Agent a Notice containing the following elements:

A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that is alleged to have been infringed;

A statement by you that you have a good faith belief that the use of the material identified in your Notice in the manner complained of is not authorized by the copyright owner, its agent, or the law;

Your Personal Information/Privacy Policy

Most data PMA collects are used only to help PMA better serve its members and visitors. It is our general policy to collect and store only personal information that our members and visitors knowingly provide. If our privacy policies change, we will notify users by an announcement placed on this page.

Collection From General Users

In general, you can visit PMA's sites on the Web without telling us who you are and without revealing any information about yourself. PMA does not collect any personal information from users browsing its websites. Users to the public areas of PMA's websites browse anonymously. Only aggregate data -- such as the number of hits per page -- are collected. Aggregate data are only used for internal and marketing purposes and do not provide any personally identifying information.

You may choose to give us personal information, such as your name and address or e-mail address that may be needed, for example, to correspond with you, to process an order or register you for an event, or to provide you with a subscription and when you enter promotions.

Collection From PMA Members, Event Registrants, and Other Customers

To gain access to members-only resources, register for events, and purchase from Marketplace, members and other users are asked to register and/or provide some information. This data is submitted voluntarily. PMA asks users to provide their name, member number (for members), and contact information. Similar information may be submitted to PMA through membership applications, conference or seminar registration, publication subscriptions, Marketplace orders and promotion registrations. Additionally, for some e-mails sent in HTML format, PMA will collect specific information regarding what the recipient does with that e-mail. For those e-mails, PMA may monitor whether a recipient subsequently clicks through to links provided in the message. Other information collected through this tracking feature may include: e-mail address of a user, the date and time of the user's "click," a message number, name of the list from which the message was sent, tracking URL number and destination page. PMA only uses this information to enhance its products and distribution of those products. This information is sold or distributed only with your permission.

In certain areas PMA uses industry-standard SSL encryption to protect data transmissions.

Credit Card Account Information

PMA does not disclose credit card account information provided by its members and customers. When members and customers choose to pay using their credit cards, PMA submits the information needed to obtain payment to the appropriate clearinghouse.

Editing Your Account Information and Preferences

PMA uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal analysis.

User Forums; Prohibited Communications

PMA may, but is not obligated to, monitor or review:

  • any areas on the site where users transmit or post communications or communicate solely with each other, including but not limited to chat rooms, bulletin boards or other user forums, and
  • the content of any such communications.

PMA, however, will have no liability related to the content of any such communications, whether or not arising under the laws of antitrust, copyright, libel, privacy, obscenity, or otherwise. PMA also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any materials that are posted to the site by users.

  • You may not post or transmit any message, data, image or program that would violate the property rights of others, including unauthorized copyrighted text, images or programs, trade secrets or other confidential proprietary information, and trademarks or service marks used in an infringing fashion.
  • You may not interfere with other users use of the site.
  • You may not post or transmit any file which contains viruses, worms, "Trojan horses" or any other contaminating or destructive features.
  • You may not post or transmit any message which is harmful, threatening, abusive or hateful. It is not PMA's intent to discourage you from taking controversial positions or expressing vigorously what may be unpopular views; however, PMA reserves the right to take such action as it deems appropriate in cases where the site, Technical Forum and/or MemberNet Discussion Areas are used to disseminate statements which are deeply and widely offensive and/or harmful.
  • You may not post or transmit charity requests, petitions for signatures, chain letters or letters relating to pyramid schemes.
